HRDRV Terms of Service

1. Accounts

• You must be a real individual and provide accurate, complete information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• HRDRV may suspend or terminate accounts that violate these Terms or misuse the platform, with or without notice.

2. Memberships & Payments

• HRDRV memberships are billed on a recurring basis and are non-refundable.
• You may cancel your membership at any time prior to your next billing date to avoid future charges.
• Membership grants access to HRDRV tools and features but does not guarantee results, earnings, placements, or opportunities.
• Billing and cancellation are managed through your account settings.
• Support inquiries may be directed to [email protected].

3. AI Usage Policy

HRDRV is designed to support and protect human creativity and lawful rights.

HRDRV may remove content that violates this policy at its sole discretion.

4. Music Distribution

• Distribution services offered through HRDRV are optional and application-based.
• If accepted, HRDRV receives a 5% commission on net streaming revenue, unless otherwise agreed in writing.
• Upon cancellation of your membership, distributed content may be removed from stores within 14 days.
• HRDRV may reject or remove content that is infringing, artificially streamed, poorly mixed, offensive, or otherwise legally problematic.
• Appeals may be requested if you believe content was removed in error.

5. Sync Pitching (Pitch by HRDRV)

HRDRV may provide access to non-exclusive sync pitching services.

These terms apply only to placements secured through HRDRV's pitching efforts and do not apply to music you upload independently or place elsewhere.

6. Service Providers & Contractors

• Service providers on HRDRV are independent contractors, not employees or agents of HRDRV.
• HRDRV receives a 12% platform service fee on transactions completed through HRDRV.
• All communication and transactions must occur on-platform.
• HRDRV does not support or protect off-platform communication, payment, or solicitation.

7. Platform Ecosystem & Additional Products

HRDRV is part of a broader ecosystem of products, tools, and services operated by HRDRV Inc. (collectively, the "HRDRV Products"), which may include, but are not limited to, Pitch, distribution services, community platforms, events, and future offerings.

Each HRDRV Product may have its own separate terms, policies, or agreements ("Product Terms") governing its use.

By accessing or using any HRDRV Product, you agree that:

• You are subject to these Terms, as well as any applicable Product Terms.
• Each product operates independently and may have different rules, eligibility requirements, pricing, or obligations.
• HRDRV does not supervise, manage, or assume responsibility for activity occurring on one product solely because you use another.
• Compliance with one product's terms does not exempt you from compliance with another product's terms.
• In the event of a conflict, the product-specific terms control for that product, while these Terms continue to govern your overall relationship with HRDRV Inc.

Your continued use of any HRDRV Product constitutes acceptance of the applicable terms for all HRDRV-operated platforms you access.

8. User Conduct

You agree not to:

• Hack, spam, scrape, or interfere with the platform.
• Impersonate others or misrepresent your identity.
• Share private or confidential information without authorization.
• Upload hateful, illegal, or infringing content.
• Use HRDRV branding without permission.

9. Limitation of Liability

HRDRV is provided "as is" and "as available."

HRDRV is not liable for:

• Third-party actions or services
• Platform interruptions or data loss
• Missed opportunities or outcomes
• Content you fail to back up

Your use of the platform is at your own risk.

10. Dispute Resolution & Arbitration

• All disputes arising from or relating to these Terms are subject to binding arbitration.
• You waive the right to jury trials and class actions.
• Arbitration is governed by the U.S. Federal Arbitration Act.

11. Communications

• By using HRDRV, you consent to receive communications from HRDRV.
• Email communications may be unsubscribed from by contacting [email protected].
• SMS communications (if applicable) may be opted out of by replying "STOP".

12. Governing Law & Miscellaneous

• These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
• If any provision is found invalid, the remaining provisions remain in effect.
• These Terms constitute the entire agreement between you and HRDRV regarding your use of HRDRV Products.
